About the placement of information about created inventions at the Internet site and time of request filing, we notify.

 
     According to part one of Section 7 of the Law of Ukraine "About protection of inventions and utility models (hereinafter - Law) invention meets patentability conditions if it is new, has design level and is industrially applicable. 
     According to the third part of present section, invention (utility model) recognized as new, if it is not part of machinery.  
     According to Section 7 of technology level includes all information that became public in the world to the date of application to the institution or, if priority is claimed, to give it priority.
      At the same time according to the sixth part of Section 7 of the Law, in recognition of invention (utility model) patentability not affect disclosure of the inventor or a person who has received from the inventor directly or indirectly, such information within 12 months before the date of filing of request or, if priority is claimed, till the date of it`s priority.
     So, after posting information about the invention (utility model) on the Internet website, to which vague circle of people has free access, it become public, thus becoming part of technology for the application, which filed after the date of such placement.
      However, if the to the institution request for invention (utility model) applied till the end of 12 months period from the date of disclosure of the invention by inventor or a person who has received from the inventor directly or indirectly, such information referred to the disclosure, including the Internet, does not affect recognition of the invention (utility model) patentability.
